Divorce: Community Property vs Separate Property - Austin, Dallas, Round Rock and all of Central Texas
Community property is typically everything that is acquired during the marriage. While separate property are things that were owned before the marriage existed, gifts, bequests and a few other types of property. It is important that property is appropriately characterized as either community or separate property during a divorce.
The Court will usually divide community property between the two parties while the Court cannot divide separate property and the party that originally owned it is allowed to retain the property.
